Allegation against: Dr Douglas Deans and Dr Gary Mearns
Nature of allegation: Breach of the provisions in the Orkney NHS Board's Code of Conduct set out in paragraphs 5.18 and 5.19 relating to Declaration of Interests.
Outcome:

Decision that it could not reasonably or safely be concluded that either Dr Deans or Dr Mearns contravened the Orkney NHS Code of Conduct.

It was also decided to recommend to Orkney NHS Board that it should consider proposals which would enable members of the Board, who are also involved in service delivery, to participate - in appropriate circumstances - in the business of the Board.

A public interest report was issued to the Standards Commission on the case.

The Standards Commission took the decision to write to the Chair of the Orkney NHS Board to draw their attention to the corporate governance issues raised by the Chief Investigation Officer's investigation.
