Nature of allegation: Moray Council requested that the Chief Investigating Officer investigate a number of planning decisions contrary to officer recommendations.
Outcome: Following consideration, the Chief Investigating Officer was unable to undertake the general investigation requested by Moray Council. The letter attached was forwarded to the Council and it was hoped the comments and advice would be of some assistance to the authority.

Outcome: Decision that, having regard to the fact that the Councillors' Code of Conduct only came into effect on 1 May 2003, it was not possible to conclude that Councillor John Hogg's conduct thereafter, by itself, amounted to a breach of the Code and I found accordingly in terms of this complaint.
